Recent Developments in Environmental and Aboriginal Issues Facing the Mining Industry

 

Abstract: Mining projects, in addition to solving myriad technical challenges to be successful, must also develop pragmatic approaches that address environmental regulatory requirements and Aboriginal obligations.  These rapidly evolving aspects of project development can have significant impacts on the success or failure of mining undertakings.  The recent report of the panel examining federal environmental assessment and cases before the Supreme Court of Canada, such as that brought by the Nunavut Hamlet of Clyde River, dealing with Aboriginal consultation factor prominently among the issues changing the landscape.  In his presentation, Adam will share the general state of these areas in the context of mining development and will highlight recent regulatory and legal developments related to environmental assessment and Aboriginal law and consultation.

 

BIO: Adam Chamberlain is a partner with BLG’s Toronto office and National Leader of the firm’s northern practice group, Team North. Adam is a member of the Nunavut, Northwest Territories, Ontario and Yukon Bars and is a Certified Specialist in the area of Environmental Law. He is active in BLG’s Mining and Aboriginal practices and has worked for many years on matters where the two areas intersect. He has advised mining companies and others in the mining sector in matters including environmental assessment, Aboriginal consultation and the negotiation and implementation of Impact and Benefit Agreements. He is currently counsel to the Government of Nunavut in its negotiations with the Government of Canada and Nunavut Tunngavik Inc. related to the “devolution” of natural resources legislative powers by Canada to Nunavut.

Adam is especially proud of his work with Camp Awakening, a charity that sends children with physical disabilities to summer camp in a setting that integrates them with able bodied children.
